
The Background:

In early 1994 I was diagnosed with diabetes and received the three day diabetes
training provided by the PEI Diabetes Association where I was introduced to the Canadian Diabetes Association Food Choice Values and Symbols.
Later in 1994 I contacted the Canadian Diabetes Association to inquire about information on the CDA Food Choice Value symbols, found on many varieties of food packaging at the time, even more today. At the time they did not have a web site, so I asked if I could have whatever material they had to use to create a web page explaining their purpose, preferably in digital format. (I didn't want to have to re-type the info..) Several days later attached to an email was the WordPerfect file containing the information I had requested. It even contained the symbols themselves but for some technical reason Ami Pro could not convert the graphic symbols and I was forced to reproduce them by hand in Windows Paint. They were close but certainly not an exact match, but I was sure the visitor reading the information would get the general idea of what they should look like and recognize them on a cereal box. Later, when the Canadian Diabetes Association get a web site up, I provided links from at least 10 pages not including the CDA food choice values and symbols page. Then in late 1998 or early 99 I received an email and voice mail message from a lady stating she was calling from the Canadian Diabetes Association and I was to remove the web page cda_0.html as the information was copyright by the Canadian Diabetes Association (CDA) or legal action would be taken. I contacted the Canadian Copyright office and asked for a search for copyright's on the food choice value system and the symbols. Maybe a week later someone called from the copyright office and left a message that nothing was found, but I should use their web site to search trademarks for the symbols. I did and didn't find anything. I called the Canadian Diabetes Association (CDA) and spoke with a woman about this issue and explained that I was given this material to post and would be more interested in modifying the page and creating reciprocal links between the Canadian Diabetes Association web site and mine. This person informed me that was not possible, they wanted the page removed because when doing a search for the Canadian Diabetes Association Food Choice Values/Symbols they kept getting my page. You mean that's all this boils down to is who is higher in the search engines!! |
The Present Situation:

Still working on this portion while I await a legal opinion as to whether a modified version of the original page falls within the "fair use" provision of the copyright act. In the mean time this page falls outside any copyright the Canadian Diabetes Association can claim to the present content.
That's of course if content is the issue!
Personally, I believe where the my page places in the search engines is the motivating factor for this harassment and copyright is just an excuse to get the page removed.
Otherwise, they would have contacted me directly by letter, would have explained
they are withdrawing any previous permission I had to use the material, and
ASKED me to remove their copyright content. They certainly wouldn't have
been going behind my back to the isp hosting my pages and try to have the page removed
without my knowledge.
OH. DID I FORGET TO MENTION NO ONE FROM THE CANADIAN DIABETES ASSOCIATION HAS CONTACTED
DIRECTLY ABOUT THIS MATTER!!!
I guess they have been too busy subtly threatening my isp to be bothered to contact me..
Actually I am considering leaving this page "as is" with a short review of the email exchanged between the Canadian Diabetes Association going behind my back and trying to have my ISP remove the page without consulting with me.
