Upon the request of defence counsel and with the consent of the Judiciary, Crown and local Aboriginal band council, sentencing circles are provided on a case by case basis.
A number of circles have been held in Woodstock, NB. The circles use traditional practices such as sweet grass and the talking stick and eagle feather, as well as Native prayer and drumming. Participating in the circle are the offender, the victim, their supports, elders in the community, the Crown Prosecutor, the Defence Attorney and resource professionals (ex. addictions, probation) who assist the Provincial Court Judge, also present, in the sentencing process. |

Attempts are made to address and integrate the needs of both the community and the offender in the sentencing process through the use of sentencing circles.
In the fall of 1998, a week-long conference on circle sentencing was delivered in Conne River, NF, by the Aboriginal Justice Learning Network. The conference was held to provide information to help the community prepare for a sentencing circle that was requested by an offender and which was actually held as part of the conference. Over 50 people participated including elders, community people, police, probation officers and protection workers.
The Aboriginal Justice Learning Network is open to doing similar conferences in other locations in Atlantic Canada. |

Youth Alternative Society

There are 7 organizations in Nova Scotia which implement the Alternative Measures program allowing young offenders and their parents or support persons to meet with a trained community volunteer, the victim and, in some cases, a police officer, to discuss why the crime was committed and what effect it had on the people gathered. The volunteers help the group to develop a mutually satisfactory agreement about how to resolve the issues created by the offence. Four of the 7 offices, including the Youth Alternative Society, are involved in the first Phase of the Restorative Justice Program for Nova Scotia. |

Mi'kmaq Young Offender Program

A project of the Mi'kmaq Justice Institute, this program uses talking circles to assist parties to negotiate Alternative Measures agreements. The young person, his or her parents, the victim and his or her supports, the police and others affected by the offence meet together with a facilitator in a talking circle which resolves issues using a holistic approach. |

Coalition of Youth Justice Committees

In Newfoundland, the model chosen for Alternative Measures is one of volunteer community management in partnership with government.
There are 29 different Youth Justice Committees in the province. Volunteers are trained to assist young offenders to develop an Alternative Measures agreement, which can come about through victim offender mediation, victim offender conciliation, or through an agreement negotiated by the volunteer and the offender, with no input from the victim. |
